Electronic discovery (e-discovery) is a constantly evolving area of the law. While technology is part and parcel to all e-discovery projects, the success of those projects require attention to and an understanding of far more than technology itself. It is imperative that e-discovery professionals understand thoroughly each stage of the process in order to incorporate best practices and comply with legal requirements. All key players from the business units involved with a legal matter, IT, records management, compliance, and legal departments must work together as a team to ensure corporate policies and legal obligations are being met and to minimize risk to the organization during the discovery phase of litigation or an investigation. From preservation to production, there are numerous critical steps that must be managed throughout the discovery process. Therefore policies, procedures, and guidelines must be established, understood, and followed by all key players involved in the matter.
